Chapter 7 Bankruptcy and Stopping Home Foreclosure

Contrary to popular opinion, Chapter 7 bankruptcy may still be an option for families who want to erase debt but still stop foreclosure and keep their homes. Under Michigan law, homes up to a certain value will be exempt from the usual Chapter 7 requirement that the debtor turn over all property to cover his or her debts. Also, for families whose homes are worth less than the value of their mortgage (upside-down mortgages), Chapter 7 may provide relief.

Chapter 13 Bankruptcy and Stopping Home Foreclosure

Chapter 13 bankruptcy is a more common tool for stopping home foreclosure. Under Chapter 13 bankruptcy, you propose a debt repayment plan that is more manageable than your current debt load. If the court approves your proposed repayment plan, then your mortgage lender must accept the lower monthly payment.
